“Website” means www.webswing.org and any page, document or sub‑domain owned and operated by Webswing.

“Client Portal” means the sign‑in area hosted at portal.webswing.org (or successor URL).

“Webswing Technology” means any software, binaries, demos, examples, documentation, or other materials we make available on the Website or Client Portal.

“Temporary Permission” has the meaning set out in section 4.

“You” / “your” means the natural or legal person accessing the Website or Webswing Technology.

2. Acceptance

By accessing the Website, downloading Webswing Technology, or creating a Client Portal account, you agree to be bound by these Terms. If you do not agree, please leave the Website immediately and do not download or use Webswing Technology.

3. Purpose of Site

The Website is provided for general information and evaluation only. Nothing on the Website constitutes legal, financial, engineering or other professional advice.

4. License for Evaluation (“Temporary Permission”)

4.1. Subject to these Terms, Webswing grants you a non‑exclusive, non‑transferable, revocable license to download and use the evaluation version of Webswing Technology solely for internal testing and evaluation.

4.2. Temporary Permission does not permit any:

(a) production, commercial or governmental use;

(b) public hosting or resale; or

4.3. The Permission terminates automatically upon breach of these Terms or upon written notice from Webswing. Upon termination, you must delete all copies.

5. Commercial Use

Any commercial, production or customer‑facing, or internal organizational use/deployment of Webswing Technology – whether for your own operations or for third parties - requires a separate written license or subscription agreement with Webswing. Evaluation versions may not be used as a substitute for a paid license.

6. Intellectual‑Property Rights

Webswing (or its licensors) owns all intellectual‑property rights in the Website, Client Portal and Webswing Technology. Except for Temporary Permission, no rights are granted or implied. You must not remove copyright notices, copy, frame, mirror or scrape the Website or Webswing Technology.

7. Disclaimer of Warranties

The Website and Webswing Technology are provided “as is” without warranty of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability). Content may contain errors or be out‑of‑date; Webswing is under no obligation to update it.

8. Limitation of Liability

To the fullest extent permitted by Irish law, Webswing shall not be liable for any indirect, consequential, special, or incidental damages (including lost profits, business interruption, or data loss). Webswing’s total aggregate liability arising out of or related to these Terms shall not exceed the greater of one thousand euros (€1,000).

9. Indemnity

You agree to indemnify and hold harmless Webswing, its officers, employees and agents from any claims, losses or expenses arising out of your breach of these Terms or misuse of the Website or Webswing Technology.

10. Links to Third‑Party Sites

Links on the Website may lead to external sites. Webswing is not responsible for, and does not endorse, the content of those sites. Use them at your own risk.

11. Viruses

While we use reasonable efforts to secure the Website, we do not warrant that it will be free from viruses or other harmful components. You are responsible for implementing adequate antivirus protection.

12. Privacy & Cookies

Our Privacy Policy published on this Website form part of these Terms. By using the Website you consent to our processing of personal data and use of cookies as described therein.

13. Termination and Suspension

Webswing may suspend or terminate your access to the Website or Client Portal at any time without liability if you breach these Terms or if required by law.

14. Changes to Terms

Webswing may update these Terms at any time. Material changes will be posted on the Website. Continued use after changes constitute acceptance.

15. Severability

If any provision is held invalid by a competent court, the remaining provisions shall remain in full force.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland. The courts of Dublin have exclusive jurisdiction over any dispute arising from or related to these Terms, the Website, or Webswing Technology.
