We decided to change the license to AGPLv3 in order to foster the idea of free and open source software. Our revenue comes from customers who recognize significant cost savings when they adopt our solution, instead of rewriting their application or self hosting and managing open source solutions on their own. Nimirium provides its Webswing server under a dual license model designed to meet the development and distribution needs of both commercial distributors (such as OEMs, ISVs and VARs) and open source projects.
For Open Source Projects and Other Developers of Open Source Applications:
For developers of Free Open Source Software (FOSS) applications under the AGPL that want to combine and distribute those FOSS applications with Webswing, the AGPL licensed Webswing is the best option. For developers and distributors of open source software under a FOSS license other than the GPL, please contact firstname.lastname@example.org and Nimirium will give FOSS Exception under certain conditions without causing the entire derivative work to be subject to the AGPL.
For OEMs, ISVs, VARs and Other Distributors of Commercial Applications:
OEMs (Original Equipment Manufacturers), ISVs (Independent Software Vendors), VARs (Value Added Resellers) and other distributors that combine and distribute commercially licensed software with Webswing and do not wish to distribute the source code for the commercially licensed software under version 3 of the GNU Affero General Public License (AGPLv3) must enter into a commercial license agreement with Nimirium.
Existing Customers with Support Agreement:
Our customers with valid commercial support agreement are not affected by the change for the duration of the agreement. If you need official license exception please let us know at email@example.com

During the development and testing you do not need to buy commercial license.
Your application together with Webswing is considered a combined work. Webswing can't do what your application does, nor your application can't be distributed over the browser without Webswing.
In the sense of AGPL, you must make your own source code freely available. If you do not want to publish your source code then you must buy a license exception.
At the moment we provide two types of commercial licensing. When you subscribe our commercial support Nimirium will give you license exception for the period of the subscription. If you do not need our support then please contact firstname.lastname@example.org and we will sell you a commercial license according to your requirements (number of Webswing units).
